By accessing or using QuickMind (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
QuickMind is a mobile application that provides daily brain training challenges, puzzles, logic games, and quests designed to improve cognitive skills. The Service includes features such as daily challenges, progress tracking, achievement systems, and social sharing capabilities.
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You must be at least 13 years old (or the applicable age of consent in your jurisdiction) to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates any applicable law or regulation; infringes upon or violates our intellectual property rights or the intellectual property rights of others; harasses, abuses, insults, harms, defames, slanders, disparages, intimidates, or discriminates; submits false or misleading information; uploads or transmits viruses or any other type of malicious code; attempts to gain unauthorized access to the Service or its related systems; interferes with or disrupts the Service or servers or networks connected to the Service; or uses any automated system, including robots, spiders, or scrapers, to access the Service.
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by QuickMind, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
The Service may allow you to post, submit, or otherwise make available content, including scores, achievements, and comments ("User Content"). You retain ownership of your User Content, but by making User Content available through the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.
The Service may offer in-app purchases, subscriptions, or other paid features. All purchases are final and non-refundable, except as required by law or as expressly stated in these Terms. Prices for our products are subject to change without notice.
If you purchase a subscription, your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date. You can manage your subscription and turn off auto-renewal through your device's account settings.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the app settings or by contacting us at support@quickmind.app.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.
To the maximum extent permitted by applicable law, in no event shall QuickMind, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service; any conduct or content of any third party on the Service; or unauthorized access, use, or alteration of your transmissions or content.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Paris, France.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms.
